trade mastermind academy terms

These Terms & Conditions (“Terms”) apply to all programmes delivered by Trade Mastermind Ltd. By signing the Order Form and checking the Terms box, the Customer (“you”) agrees to be bound by these Terms.

1. Programme Access & Services

Upon enrolment and payment of the Initial Payment, you receive immediate access to:

  • Trade Mastermind online portal
  • Digital training materials
  • Frameworks, tools, templates
  • Trade Mastermind Community
  • Strategy & masterclass modules
  • Support channels

You are entitled to 12 live training days per year.

Access is personal and non-transferable.

We may update or modify the programme structure, format or delivery methods at any time to improve the experience.

2. Contract Length & Commitment
Contract term (12 or 36 months) is selected on the Order Form.

This is a fixed-term, fixed-value contract.

You agree to pay the full contract value regardless of attendance, usage or results.

Not attending sessions does not reduce or cancel payment obligations.

3. Payments
Payments must be made by Direct Debit, recurring card payment or approved finance provider.

All payments, including the Initial Payment, are non-refundable.

You must ensure funds are available for each scheduled payment.

Agreements with finance providers do not replace or cancel your obligations under this contract.

4. Finance Providers
If you use a finance provider, you must comply with their terms.

Cancelling or reversing payments with a finance provider does not cancel this contract.

We may take appropriate steps if finance arrangements are interrupted.

5. Payment Terms & Managing Overdue Balances

We understand that delays can happen. If a payment is missed, we will always try to contact you and work with you to get things back on track.

If any payment is more than 7 days overdue, reasonable late fees may apply, and we will always notify you in advance.

If any payment is more than 30 days overdue, the remaining balance for the full contract term may become payable. We will always discuss the available options with you.

Access to the Programme may be temporarily paused until payments are brought up to date.

Payment Support Plans:

  • If needed, we can explore temporary payment arrangements.
  • Support plans are discretionary
  • ⁠Interest may apply on extended schedules
  • Support arrangements do not reduce or cancel the contract value

We aim to support all customers who communicate proactively.

6. Value Delivery & 70/30 Revenue Allocation

Upon enrolment, you receive substantial value upfront, including digital assets, portal access, community access, strategy materials, and onboarding.

These elements represent the majority of the programme’s overall value.

Trade Mastermind allocates 70% of the contract value to initial delivery and onboarding, with the remaining 30% tied to ongoing sessions and support.

Monthly payments exist for convenience and do not reflect value delivery timing.

7. Programme Delivery, Attendance Options & Force Majeure

7.1 Programme Delivery Format (Virtual = Valid Delivery)

Trade Mastermind may deliver the Programme through in-person sessions, live virtual sessions, online learning, or digital resources.
Replacing an in-person session with virtual delivery constitutes full and valid delivery of the Programme.

7.2 Attendance Options

If you purchased an In-Person Programme, you may attend either:

  • In person, or
  • Virtually

If you purchased a Virtual-Only Programme, you may only attend virtually unless an upgrade is purchased separately.

7.3 Force Majeure & Continuity of Service

Neither party shall be liable for any delay or failure to perform its obligations under this Agreement where such delay or failure results from events, circumstances or causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, industrial action, government restrictions, changes in law, public health emergencies, pandemics, epidemics, lockdowns, natural disasters, or failure of utilities or transport networks (“Force Majeure Event”).

Where a Force Majeure Event prevents or restricts the delivery of any in-person services, training, events or sessions, Trade Mastermind Ltd reserves the right to continue delivery of the Services in an alternative format, including but not limited to virtual delivery, online training, recorded sessions, or access via the Trade Mastermind Online University.

All Trade Mastermind programmes and academies include access to the Trade Mastermind Online University, which shall operate as the default backup delivery method in the event that in-person or live delivery is disrupted, restricted or unavailable for any reason.

For the avoidance of doubt, the occurrence of a Force Majeure Event shall not relieve the Client of their obligation to pay any fees due under this Agreement, and all payments shall remain due and payable in full and on time, regardless of whether delivery continues in-person, virtually, online, or is temporarily disrupted.

No Force Majeure Event shall constitute grounds for suspension, reduction, withholding or cancellation of payments due under this Agreement.

7.4 Event Scheduling Adjustments

Trade Mastermind may adjust dates, locations or formats where reasonably required. These adjustments do not give rise to cancellation or refund rights.

8. Cooling-Off Period & Cancellation

8.1 You may cancel within 7 days of signing the Order Form if:

  • ⁠You request cancellation within 7 days
  • You attend the mandatory exit interview

Failure to attend the exit interview voids cancellation.

After 7 days, the contract becomes non-cancellable.

8.2 Return of Property as Condition of Cancellation

8.1 As part of enrolment, the Client may be issued with physical Welcome Packs, materials, branded items, documentation or other Trade Mastermind property (“TM Property”).

8.2 Where the Client seeks to cancel this Agreement, official cancellation shall not be deemed complete until all TM Property has been returned to us.

8.3 All TM Property must be:

  • returned in full;
  • returned within the timeframe specified by us;
  • undamaged, unaltered and in reasonable condition (fair wear and tear excepted).

8.4 We reserve the right to:

  • delay or withhold confirmation of cancellation;
  • suspend or delay any refunds (where applicable);
  • continue collection of payments,
    until all TM Property has been received and inspected.

8.5 Where TM Property is returned damaged, incomplete, altered or not returned at all, we reserve the right to apply reasonable replacement or repair charges, which shall become immediately payable.

9. Conduct

Respectful behaviour is required at all times. Disruptive or abusive behaviour may result in paused or withdrawn access. No refunds apply in such cases.

10. System Rules

Do not share login details or misuse systems, tools or content.

11. Intellectual Property
All materials, frameworks and resources remain the intellectual property of Trade Mastermind and may not be copied, taught, resold or distributed.
12. Confidentiality
You must not disclose confidential information about Trade Mastermind, its staff, customers or operations.
13. Limitation of Liability
  • No guarantee of specific financial outcomes
  • Not liable for loss of business, contracts, profits, data or indirect losses
  • Does not limit liability for death, injury or fraud
14. Termination

Trade Mastermind may pause or terminate access if you:

  • Fail to pay
  • Breach these Terms
  • Misuse intellectual property
  • Behave abusively
  • Violate system rules

Termination does not cancel your obligation to pay the full contract value.

15. Business Accreditation (City & Guilds / Trade Mastermind Accreditation)

15.1 Upon completion of the Trade Mastermind Academy, and where the Client enrols in and completes the three-year City & Guilds accredited programme, the Client shall be recognised as Trade Mastermind Business-Accredited for the duration of their active Academy term and shall receive certification upon successful completion.

15.2 Business Accreditation includes, but is not limited to:

  • allocation of an official Trade Mastermind Business Membership Number;
  • access to accreditation emblems, logos and digital badges;
  • provision of a scannable QR code linked to the Client’s membership and referral identification;
  • inclusion within the Trade Mastermind accredited business network and related benefits as determined by us from time to time.

15.3 Following completion or expiry of the Academy term, the Client’s Business Accreditation shall continue on an ongoing subscription basis.

15.4 Where the Client continues to use or display the Trade Mastermind and/or City & Guilds Business-Accredited emblems, membership number, QR code, branding, or associated benefits following completion or expiry of their Academy term, an automatic ongoing Business Accreditation fee shall apply.

15.5 The Business Accreditation subscription shall:

  • renew automatically on a rolling monthly basis;
  • be collected using the Client’s existing payment method;
  • continue unless cancelled by the Client in writing with not less than thirty (30) days’ notice.

15.6 If the Business Accreditation subscription is cancelled or payment fails, the Client must immediately cease all use and display of:

  • Trade Mastermind and/or City & Guilds accreditation logos;
  • membership numbers;
  • QR codes;
  • vehicle livery, marketing materials, websites, social media or any other representations suggesting current accreditation.
16. Academy Term, Renewal & Automatic Roll-On

Year One → Year Two → Year Three

16.1 Where the Client enrols on a one-year Academy programme, the Agreement shall automatically renew into the subsequent Academy year (Year Two, then Year Three) unless cancelled in accordance with clause 3.2.

16.2 To prevent automatic renewal into the next Academy year, the Client must provide written notice of cancellation during the eleventh (11th) or twelfth (12th) month of the then-current Academy term, giving not less than thirty (30) days’ notice prior to the renewal date.

16.3 Failure to provide valid notice within this period shall result in the Client being automatically enrolled into the next Academy year, and all associated fees shall become due and payable.

16.4 Cancellation requests made outside of the notice window shall not prevent renewal and shall take effect only at the end of the subsequent contract term.

17. Alumni Programme (Automatic Roll-On After Year Three)

Alumni Membership Terms

17.1 Upon completion of the full three-year Trade Mastermind Academy programme, the Client shall automatically roll onto the Trade Mastermind Alumni Programme unless cancelled in accordance with clause 4.4.

17.2 The Alumni Programme includes, but is not limited to:

  • access to Trade Mastermind Academies (as determined by us);
  • access to Trade Mastermind community events;
  • continued participation in Trade Mastermind WhatsApp and community groups;
  • ongoing community-level access, resources and benefits.

17.3 The Alumni Programme shall be charged at an ongoing Alumni membership fee, collected automatically on a rolling monthly basis using the Client’s existing payment method.

17.4 To opt out of the Alumni Programme, the Client must provide written notice during the final month of the Academy (Year Three), giving not less than thirty (30) days’ notice prior to the end of the Academy term.

17.5 If valid notice is not received within this timeframe, the Alumni Programme shall auto-renew and fees shall become due and payable.

17.6 The Alumni Programme is separate and distinct from Business Accreditation, which is governed by clause 1 and may be held independently.

18. Hierarchy & Enforcement

18.1 These clauses form part of the Master Contract and Academy Terms & Conditions.

18.2 In the event of any inconsistency between sales materials, verbal representations, order forms, price schedules or summaries, these Terms shall prevail.

18.3 All automatic renewals, subscriptions and ongoing fees authorised under this Agreement constitute the Client’s express consent to recurring payments.

19. General

We may assign this contract. You may not transfer it.

English law applies.
